We are Case By Case (CBC) Travel and are excited to help you with your travel. This agreement (the "Agreement") sets forth the terms and conditions under which Case By Case (CBC) Travel (referred to as "the Company" or "we") will provide travel services to our valued clients (referred to as "the Client" or "you"). By engaging in business with Case By Case (CBC) Travel, the Client acknowledges and agrees to be bound by the terms and conditions outlined herein.
1. Services Provided:
1.1 Case By Case (CBC) Travel agrees to provide travel-related services, including but not limited to flight bookings, hotel accommodations, tour packages, and travel itineraries, as requested by the Client.
2. Client Expectations:
2.1 The Client is expected to provide accurate and complete information regarding travel preferences, contact details, and any other necessary data to facilitate the booking process.
2.2 The Client should review and verify all travel documents, itineraries, and bookings provided by Case By Case (CBC) Travel for accuracy and inform the Company promptly of any discrepancies.
3. Booking and Payment:
3.1 Case By Case (CBC) Travel charges a Travel Experience Planning Fee to cover the cost of research and planning services provided to the Client. This fee is non-refundable should you choose to change or cancel your trip.
The purpose of the Travel Experience Planning Fee is to compensate Case By Case (CBC) Travel for the time and effort invested in creating personalized travel proposals and itineraries, conducting research, and organizing various components of the trip. This fee helps ensure that our clients receive the highest level of dedicated service and attention to detail during the planning phase.
The specific amount of the Travel Experience Planning Fee will be communicated to the Client before the commencement of research and planning. The Travel Experience Planning Fee is a flat rate of $50.00 for individual, couple, or single-family travel planning and $100.00 for multi-family or group travel planning. This fee will be collected along with the down payment that secures the Client's booking and is non-refundable should the Client choose to change or cancel the trip thereafter. It is the responsibility of the Client to make the payment of this fee in a timely manner, as indicated by Case By Case (CBC) Travel.
The proposed itinerary may be revised up to two additional times after the initial down payment is made, without incurring any additional fees beyond the initial Travel Experience Planning Fee. The revisions allow the Client to make necessary adjustments or explore alternative options before finalizing their travel plans.
Please note that any further revisions to the proposed itinerary beyond the two allowed will be subject to additional fees, which will be communicated to the Client for approval before proceeding with the charges.
Regardless of the outcome, the Travel Experience Planning Fee remains non-refundable once the research and planning services have been initiated.
By agreeing to work with Case By Case (CBC) Travel, the Client acknowledges and accepts the terms regarding the Travel Experience Planning Fee for research and planning. We are committed to providing exceptional travel experiences, and this fee allows us to dedicate our expertise and resources to crafting a tailored and memorable journey for our valued clients.
3.2 Case By Case (CBC) Travel requests the Client remit the payment either in full or a specified deposit, as agreed upon with the travel service supplier, for the requested travel services. Payments can be made using approved payment methods. Clients are also given the option to split the payment according to the total value of the trip.
3.3 The Client understands that failure to make timely payments may result in the cancellation of reservations or bookings without any liability on Case By Case (CBC) Travel's part.
4. Cancellation and Refunds:
4.1 The Client acknowledges that cancellation policies may vary based on individual travel services such as flights, hotels, tours, etc. It is the Client's responsibility to be aware of policies before confirming bookings.
4.2 Refunds for cancellations are subject to the terms and conditions of the individual travel service providers. Case By Case (CBC) Travel will make reasonable efforts to assist the Client in obtaining applicable refunds when appropriate.
5. Travel Insurance:
5.1 Case By Case (CBC) Travel strongly advises the Client to acquire comprehensive travel insurance and trip protection to safeguard against unforeseen circumstances, such as trip cancellations, medical emergencies, or loss of baggage. We offer travel insurance options to ensure our clients have appropriate coverage during their travels. However, it is the Client's sole responsibility to obtain the suitable insurance coverage for their journey. Case By Case (CBC) Travel will be pleased to provide more information and assist in selecting the most suitable travel insurance package tailored to the Client's needs.
For your protection, Travel Insurance is strongly recommended and available upon request from InteleTravel.com, our Host Agency. You can enroll online for travel protection for Medical Expenses, Baggage Delays/Loss, Trip Delay or Cancellation, and other coverage, or your InteleTravel.com Independent Travel Advisor, Case By Case (CBC) Travel can arrange coverage for you. To decline recommended travel insurance, your signed insurance waiver is required. Final Travel Documents (tickets, vouchers, etc.) cannot be sent to you prior to receipt of the signed insurance waiver.
6. Travel Documents:
6.1 In order to book travel with Case By Case (CBC) Travel, the Client agrees to ensure that their passport remains valid for a minimum of six months beyond the date of travel. The Client bears full responsibility for obtaining and verifying all essential travel documents, including passports, visas, health certificates, and any other required permits before the commencement of their journey. Case By Case (CBC) Travel will not be held responsible for any adverse consequences arising from the Client's failure to comply with these travel document requirements. It is of utmost importance that the Client adheres to these guidelines to facilitate a seamless and enjoyable travel experience.
7. Changes to Itinerary:
7.1 In the event of changes to the Client's travel itinerary, the Client should promptly inform Case By Case (CBC) Travel. Changes are subject to availability and the policies of the respective service providers. Additional fees may apply.
8. Liability:
8.1 Case By Case (CBC) Travel acts as an intermediary between the Client and the various travel service providers. While we make every effort to ensure the accuracy and quality of the services offered, we are not liable for any injury, loss, damage, or inconvenience caused by third-party service providers.
8.2 Case By Case (CBC) Travel will not be held responsible for any unforeseen circumstances, natural disasters, political unrest, or any events beyond our control that may disrupt travel plans.
9. Confidentiality:
9.1 Both parties agree to treat any information shared during the course of business as confidential and shall not sell, distribute, or disclose it to any third party without obtaining written consent from the other party. The information provided by the Client will only be shared with relevant suppliers and partners for the sole purpose of arranging and facilitating their travel plans. Case By Case (CBC) Travel is committed to upholding the privacy and security of our clients' information, and any sharing of data will be done solely for the purpose of ensuring a seamless and personalized travel experience for the Client.
10. Termination:
10.1 Termination of Agreement: Either party has the right to terminate this agreement at any time by providing written notice to the other party. The written notice may be in the form of an email, letter, or any other written communication that allows for clear and documented proof of the termination request.
In the event of termination, the Client remains responsible for any financial obligations that were incurred before the termination date. The includes, but is not limited to:
i) Payments Made for Booked Travel Services:
If the Client has made payments for travel services that have already been booked or confirmed by Case By Case (CBC) Travel at the time of termination, those payments remain non-refundable and will be subject to the respective supplier's cancellation policies.
ii) Administrative and Planning Fees:
The administrative fee for research and planning, as well as any other applicable fees that have already been charged and incurred by Case By Case (CBC) Travel for services rendered up to the termination date, will not be refunded.
iii) Supplier Cancellation Fees:
If the termination results in the cancellation of booked travel services, the Client may be subject to additional cancellation fees imposed by the respective suppliers. These fees will vary depending on the terms and conditions of the suppliers and will be the responsibility of the Client to settle.
Upon serving written notice of termination, both parties shall promptly acknowledge the receipt of the termination notice to ensure clear communication and understanding of the termination process.
After termination, Case By Case (CBC) Travel will cease all further work on the Client's travel plans, and the Client will no longer have access to any ongoing or future planning services. The termination of this agreement shall not affect the rights, obligations, or liabilities of either party that have accrued prior.
Please note that termination of this agreement is an exceptional circumstance, and Case By Case (CBC) Travel aims to provide exceptional service and ensure satisfaction throughout the travel planning process. We encourage open communication to address any concerns or issues that may arise before considering termination. Case By Case (CBC) Travel is dedicated to resolving any queries and finding suitable solutions to meet our clients' needs.
11. Governing Law and Dispute Resolution:
11.1 This agreement shall be governed by and construed in accordance with the laws of California. Any disputes arising out of this Agreement shall be resolved through mediation or arbitration in accordance with the laws of California.
12. Amendments
11.1 Case By Case (CBC) Travel reserves the right to modify or amend this Agreement's terms and conditions. Any changes will be communicated to the Client and shall become effective upon acceptance by the Client.
13. Entire Agreement
13.1 This agreement constitutes the entire understanding between Case By Case (CBC) Travel and the Client and supersedes all prior agreements, whether written or oral.
